Massachusetts State Police Release – 08182014 – State Police make Arrests and Seize Illegally Possessed Firearm in Lowell
Yesterday morning at approximately 2:22 a.m., Trooper Douglas Dolan of the Troop A Community Action Team (A-CAT), was on patrol of Dutton Street in the city of Lowell when he observed a Nissan Altima turning onto Broadway commit a motor vehicle violation.
After an investigation and conversation with the four occupants of the vehicle, BENEDICTO PENA, 32, of Manchester was found to be in illegal possession of a loaded Smith & Wesson .40 caliber handgun. PENA was also found to have an outstanding warrant from Ipswich District Court for a previous assault with a dangerous weapon offense.
A second passenger, VICHET NGETH, 34, of Lowell was found to have two outstanding warrants from Lowell District Court for previous assault charges and an attempted murder from June 2013.
Both men were taken into custody by Trooper Dolan, assisted by Troopers Scott Quigley, David Strong and Lowell Police. Sergeant Murray of the Lowell Police Major Crimes Division also assisted on scene.
PENA was placed under arrest and brought to the Andover Barracks for booking. PENA was charged with the following offenses:
- Carry loaded large-capacity firearm on way
- Carry firearm with ammunition
- Possession of a firearm within 500 feet of a dwelling
- Possess large capacity firearm
- Unlawful possession of a firearm without a license
- Possession of ammunition without a license
- Failure to wear seat belt
NGETH was placed under arrest and brought to the Andover Barracks for booking. NGETH was charged with a civil motor vehicle violation of failure to wear seat belt, in addition to the two outstanding warrants.
