Troopers Arrest Two Men with Firearms

On Saturday December 16, Trooper Brandon Chartier, assigned to the Troop A Community Action Team, was conducting traffic enforcement on Western Avenue in Lynn when he observed a gray Nissan Altima pass his location while the operator was manipulating a cell phone. Trooper Chartier entered traffic and activated his emergency lights, then stopped the Nissan.


 Upon the vehicle coming to a full stop, Trooper Chartier approached it and identified three occupants seated inside. While speaking to the occupants, Trooper Chartier detected the strong odor of fresh Marijuana then quickly observed the handle of a pistol protruding from the coat pocket of one of the passengers, later identified as DIMITRY PHILIPPE, 20, of Malden. PHILIPPE is not licensed to possess firearms. The Trooper requested additional cruisers and was quickly backed up by Trooper Domenic Ramasci.

 

Both Troopers quickly took possession of the firearm then removed all the vehicle’s occupants to conduct a follow up investigation. While attempting to remove the firearm from PHILIPPE’s coat pocket, he initially resisted and attempted to gain control of it. After a pat-frisk of another passenger, identified as EDDIE ROJAS, 23, of Lynn, Troopers located a firearm tucked into his waistband as well. ROJAS is also not licensed to possess firearms. After conducting a search of the vehicle, Trooper Chartier located approximately six ounces of a substance suspected to be Marijuana.

 

Both men were placed under arrest and transported to the Revere Barracks for booking. The operator of the vehicle was released from the scene with a citation. ROJAS and PHILIPPE were scheduled for arraignment at Lynn District Court for the following offenses.

 

EDDIE ROJAS:

 

1.            Illegal Possession of a Firearm;

2.            Possession of a High Capacity Feeding Device;

3.            Possession of Ammunition without FID Card;

4.            Possession of a Class D Substance with Intent to Distribute; and

5.            Conspiracy to Violate Drug Law.

 

DIMITRY PHILIPPE:

 

1.            Illegal Possession of a Firearm;

2.            Possession of Ammunition without FID Card;

3.            Resisting Arrest;

4.            A&B on a Police Officer;

5.            Possession of a Class D Substance with Intent to Distribute; and

6.            Conspiracy to Violate Drug Law.
